However, the provision of the law regarding withdrawal from the contract within 14 days cannot be interpreted as the option to borrow goods free of charge. If the buyer exercises the right to withdraw from the contract within 14 days of receiving the goods, the buyer must return to the seller, within 14 days of the withdrawal, everything received under the purchase contract. If this is no longer possible (e.g., the goods have been destroyed or partially or completely consumed in the meantime), the buyer must provide monetary compensation as consideration for what can no longer be returned. If the returned goods are partially damaged, the seller may assert a claim for damages against the buyer and offset this claim against the refunded purchase price, thereby returning the purchase price to the consumer at this reduced amount.
In accordance with Section 1833 of the Civil Code, the seller may offset the purchase price to be refunded to the buyer against any reduction in the value of the returned goods.
The seller has 14 days from receipt of the returned goods to refund the purchase price.
